Child Custody and Parenting

People frequently speak about “custody” during a divorce.    New Jersey considers it in the best interest of the children to have frequent contact with both parents. We will develop a schedule for parenting time through mediation. Even if the child(ren) spend more time with one parent than the other, the schedule will provide the child(ren) access to both parents. 

Division of Assets

 New Jersey is an “equitable distribution” state. This means that all martial property in divorce is divided between the couple. Equitable does not necessarily mean equal. There are a number of factors to be considered as your situation may dictate a variance from exactly equal. During mediation you will list all assets and debts while devising a plan to distribute them between you. 

Child & Spousal Support

 New Jersey has determined that children should not be the financial victims of divorce. Both parents are obligated to contribute to their children’s financial well-being. In addition, there may be a need for one spouse to provide financial support to the other to assist in maintaining their lifestyle for a period of time. This is known as spousal support.  Child and spousal support will be decided during the mediation.
